Membership Agreement

Introduction
This is an Agreement between you (the Member), and Supp Shack ltd trading as Strength Shack, a company registered in England And Wales (registration number ), whose registered office is at Unit 1 site 18 Willowholme Industrial Estate (“Strength shack”, “The gym”, “us” or “we”).
By completing the joining process at our website and becoming a Member of Strength Shack, you are accepting all the terms and conditions in this Membership Agreement. You should only join if you have read them and accept them.
Definitions
• Administration Fee: our fees raised for changing membership terms or arising out of any breach of the terms as set out on our website.
• Gym Membership Rules: the rules governing your conduct as set out on our website at www.strengthshackgym.co.uk
- Joining Fee: you are not expected to pay a joining fee just an up front cost of the membership you have selected on the website www.strengthshackgym.co.uk prices.
- Membership: your contractual relationship with us, which can be on various different terms and they are as follows:
All out Membership: a membership that is paid upfront and had a fixed term of 12 months.
Half out Membership: a membership that is paid upfront and had a fixed term of 6 months.
- Monthly Membership Amount: the amount you agree to pay each month for your Membership. Upon joining you will pay for the remainder of the month and will be agreeing to the future monthly payment to be taken on the 1st of every month there-after for the term of 12 months.
- Blue Light Membership amount: this is under the same terms as above but on providing the additional information to ensure that you are employed by the emergence services and/or the armed forces your membership will be discounted upon check out.
- Teen membership 12-15 years old can you use the facilities under the same terms as a monthly membership apart from that when accessing the gym all teen members must be accompanied by a parent/guardian who also holds a membership with us.
• Membership Amount: the amount you agree to pay upfront for your fixed term Membership. Only applies to certain types of membership.
- Personal Training Sessions: sessions booked by you directly with an independent self-employed trainer which do not form part of this agreement and are not provided by Strength Shack. Strength Shack have no liability if the agreement with the named Personal trainer and you are in conflict.
- Day/week/monthly pass membership is a pay as you go membership and has restricted use after the duration of the selected membership no access will be granted to the facility. The Day/Week/Monthly pass has to be used by the named person only in the chosen period.
- All the above membership excluding Day/week/monthly pass memberships have the following benefits:
- Meet and greets with some of the UK leading body building athletes and supplement providers.
- Other special events that you as a member will be notified by via email.
Starting your Membership
1. Our joining process is an online process. Full membership prices and options can be found on our website (www.strengthshackgym.co.uk), to be selected by you as part of the joining process. By completing the online joining process and becoming a Member of Strength Shack, you are accepting all the terms and conditions in this Membership Agreement (insofar as they are applicable). You should only join if you have read them and accept them.
2. This Membership Agreement starts once you have accepted the terms during the online joining process. By accepting the terms, you are agreeing to pay any applicable Joining Fee, Administration Fee, Membership Amount and Monthly Membership Amount., subject in each case to any Promotional Rate that may be payable for a limited period only. These are shown at the start of the joining process and again before you confirm your payment instruction.
3. This Membership Agreement starts once you have accepted the terms during the online joining process. By accepting the terms, you are agreeing to pay any applicable Joining Fee, Administration Fee, Membership Amount and Monthly Membership Amount. These are shown at the start of the joining process and again before you confirm your payment instruction.
4. You may choose during the online joining process to start your Membership either immediately or from the 1st day of the following month that you accept the terms. We may inform you during the online joining process that a waiting list is in operation in which case your Membership starts when we inform you by email.
5. You agree to comply with Strength Shack Membership Rules and you agree to use the gym facilities and equipment in the proper manner. You must consult a member of staff if you are unsure. We are not liable for any injury you suffer through the incorrect use of our equipment or facilities.
6. You confirm that you are at least 16 years old.
7. You will be liable for any damage caused to our equipment or facilities through your negligent use.
8. You agree to tell us immediately of any changes to your personal details, including contact information; this should be done via email to enquiries@strengthshack.co.uk.
Using the gym
1. You are entitled to access and to use the gym defined by your Membership until termination or suspension of that Membership pursuant to this Agreement.
2. We will make reasonable endeavours to make available to you the rights and privileges of Membership of the gym you joined and have paid for. This includes access to the gym and gym equipment, changing areas, staff and independent self-employed trainers for general advice. We will make reasonable endeavours to communicate to you in advance if we are unable to make available to you the rights and privileges of Membership.
3. Members with a pay Membership will be able to enter the gym during specified times only, as set-out in the Definition of day/week/monthly Membership above.
Changing/Freeze your Membership
Members may request to freeze their membership under specific circumstances such as medical, travel, or personal emergencies for up to 3 months. All freeze requests must be submitted in writing to enquiries@strengthshackgym.co.uk and accompanied by official supporting documentation (e.g., doctor’s note, travel itinerary from a travel agent, letter from employer etc.). We reserve the right to approve or deny freeze requests at our sole discretion based on the validity and sufficiency of the documentation provided. Membership freezes will not be processed without appropriate documentation. This does not include the day/week/month pass memberships.
If you have a discounted Membership and you change to a new Membership product, you will waive the right to the discount (or any Promotional Rate) on the original Membership and pay the standard price on the new Membership.
If you have a discounted Membership and your Membership is terminated, you will waive the right to the discount and pay the advertised Membership Amount or Monthly Membership Amount if you later choose to re-join the Gym.
We may, with reasonable notice and at our discretion, close our premises for reasonable periods of time to carry out maintenance, repairs, refurbishment, cleaning or for other reasons outside of our control, including at least 2 days a year for necessary maintenance or other work. We will endeavour to reopen facilities as soon as is reasonably possible in these circumstances. You agree that you will not be eligible for any refund for the temporary interruption in services during the period.
Managing your permissions and data
1. There are certain email and SMS communications which it is necessary for us to send to all members, in connection with their Membership. In order to do so we will process your personal data for the purposes of performing our contractual obligations to you under the terms of your Membership. You cannot opt out of these communications. You may opt out of email and SMS communications that we may otherwise send for promotional or marketing purposes, but if you do we cannot be held responsible for any loss incurred by you not receiving gym-related communications. All processing of your personal data will be in accordance with our Privacy policy, available from www.strengthshackgym.co.uk/privacy
2. For the safety and security of you, our other members and our staff, and for associated purposes of crime prevention and detection, we operate 24-hour CCTV security in the gym. The images will be captured, processed and retained in accordance with our separate Privacy, CCTV & Cookie policy, available from www.strengthshackgym.co.uk/privacy-cookie-policy. Access to such footage will also be governed by the provisions of that policy.
3. We will securely store personal data including membership information and recorded CCTV footage in accordance with our privacy policy which is available fromwww.strengthshackgym.co.uk/privacy-cookies-policy

Special terms for blue light Memberships
1. You agree that to be eligible for a blue light Membership you must be in full or part-time employment and will provide proof of this status if requested.
Payment
1. If your Membership has an initial Membership Amount fee, you agree to pay us the full Membership Amount by credit or debit card. You will be notified of any applicable Membership Amount at the end of the online joining process, and this amount will be confirmed to you by email.
2. If your Membership has a recurring Monthly Membership Amount fee, you agree to maintain a Direct Debit instruction with your bank (or recurring international Credit Card payment for overseas members) for the Monthly Membership Amount. Your first Monthly Membership Amount is due on the date shown at the end of the online joining process (which will also be confirmed to you by email), and subsequent Monthly Membership payments will be due on the same day of each month until your Membership is cancelled.
3. If the terms on which you are accepted as a Member include an initial Promotional Rate, you agree to pay the discounted Promotional Rate as a recurring Monthly Membership Amount during the introductory period specified in the promotional or introductory offer and that thereafter we may debit for the higher standard Monthly Membership Amount specified in the promotional offer (or such higher rate as might apply) in respect of each successive month after the introductory period has lapsed and unless or until your Membership is cancelled.
4. We reserve the right, at our discretion, to change your Monthly Membership Amount fee. If this happens we’ll notify you by email not less than 3 weeks before the change is made. You are able to cancel your membership within this period, and if we don’t hear from you within the period the new Monthly Membership Amount fee will apply automatically.
5. You agree to pay us the Monthly Membership Amount regardless of whether there is any temporary interruption in services during the period, foreseen or unforeseen. In circumstances where we are required to close or restrict facilities for any reason no refunds will be due.
6. If any payment due from you is returned unpaid or not honoured, you will pay us on demand an administration fee of £9.99. Where we have stored card or Direct Debit details, this administration fee will be attempted without further notice to you, in addition to your normal membership payment
Late and Failure to Pay
1. If payment is missed access to the gym will be denied until payment is made.
2. If the payment is not made within 7 days of the date of the missed payment a reminder email will be sent out to allow payment to be settled and access to the gym will be granted.
3. If no payment is received within 14 days from the date of missed payment a second email reminder will be sent out to allow payment to be settled and access to the gym will be granted.
4. If no payment is received within 21 days from the date of missed payment a final email reminder will be sent out to allow payment to be settled and access to the gym will be granted.
5. If no payment is made within 7 days of the final reminder email, a third party debt collection agency will be instructed to collect the debt and the remaining value of the 12 month contract. At this point a £30 admin charge will be issued and all costs occurred for the recovery process will be added on to the debt and a £9.99 per month charge will be added until the debt is settled. It will be down to the discretion of the owners of Suppshack Ltd (Trading as Strength shack) if access will be granted upon the debt being settled.
Ending your Membership
1. You have the right to cancel this Agreement within 14 days from the start of the Agreement without giving any reason, but you must let us know you wish to do so within the 14-day period. You may email us at enquiries@strengthshackgym.co.uk (using the email that you used during the online joining process and the unique personal identification number PIN) that you were sent), or you may use the cancellation form which you can request from a member of staff in the gym.
2. In case of dispute you must show that you cancelled the Agreement in accordance with the cancellation terms, but for these purposes it will be sufficient to show that you sent your communication concerning your exercise of the right to cancel before the cancellation period had expired.
3. If you have requested an immediate membership start date and you cancel your Membership within the 14-day period, proportionate charges will be due. We will refund to you any Joining Fee, Membership Amount and Monthly Membership Amount you have paid us, but the refunded amount will be reduced by the higher of (a) the one-day pass rate (for your gym at the time you joined) and (b) an amount in proportion to the number of days between the start of your Membership and the date you communicated to us that you wanted to cancel. Refunds will be made no later than 14 days after the day on which we were informed about your decision to cancel, and will be made using the same means of payment you used for the initial transaction.
4. After the 14-day cancellation period you can not terminate your Membership as you have entered a 12 month contract please see our cancellation policy which can be found below. You may cancel you membership with written notice 28 days before the end date of your contract (Under very serious circumstances you membership will possibly be terminated at management discretion if evidence is provided).
If you cancel a direct debit at any time during the 12 month period your membership will be frozen with immediate effect and access will be refused until payment for the outstanding balance is paid. If no payment is made after 28 days you will then have to pay the remaining balance of your contract. Failure to do this will result in a third party debit recovery agency been appointed to resolve the issues.
5. We will terminate this Agreement and your Membership with immediate effect if you do not pay any applicable Joining Fee, Administration Fee, Membership Amount or Monthly Membership Amount when it falls due.
6. We may terminate this Agreement and cancel your Membership with immediate effect on notice to you if you breach any of the Gym Membership Rules. In this event you will no longer be able to access any of our facilities and we will not give any refund.
7. If we do not terminate your Membership if you breach any of the Gym Membership Rules, or if we give you extra time to pay if you do not pay your Joining Fee, Administration Fee, Membership Amount or Monthly Membership Amount when it falls due, that will not prevent us from subsequently enforcing the terms of this Agreement.
8. We may assign the benefit of this Agreement and our rights to a third party provided we give you notice and your rights under this Agreement will not be prejudiced.
Cancellation policy
We understand that circumstances may change, and our members may need to cancel their gym membership at the end of their contracts. To ensure a smooth cancellation process, we have established the following cancellation policy:
Members who wish to cancel their membership must contact the gym reception/email or phone at least one month prior to the contract end date. This allows us to process the cancellation and update our records accordingly. Please find our opening times at www.strengthshackgym.co.uk
If a cancellation is not requested by the required deadline, the membership will automatically renew for another term, and the member will be responsible for all associated fees.
Our early cancellation policy only allows for the termination of your agreement without penalty if you relocate more than 50 miles away from the CA25RT service area. To qualify for this exemption, you must provide proof of your new address within the specified distance. This policy ensures that customers who experience significant changes in their living situation due to relocation can cancel their service without incurring additional charges, as long as the move is outside the 50-mile radius from CA25RT.
Our cancellation policy allows for early termination of your agreement in the event of a medical condition that prevents you from continuing your training. To qualify for this exemption, you must provide valid medical documentation from a licensed healthcare provider confirming that your condition makes it impossible for you to participate in training.
We value all of our members and hope that they will continue to enjoy the benefits of our gym. If you have any questions or concerns regarding our cancellation policy, please do not hesitate to contact us.
Damage and Misuse
Any damage caused to the premises, equipment, or facilities due to a member’s negligence, reckless behaviour, or intentional misuse will be the sole responsibility of the individual involved. The member shall be liable for all repair or replacement costs resulting from such damage. In cases of serious misconduct or intentional damage, the membership will be terminated with immediate effect and legal and/or police action will be taken. In such cases, the member will also be required to pay the remaining balance of their membership contract, along with any applicable administrative fees incurred as a result of the incident.
Unauthorised Access
Strictly no member is permitted to allow any non-member access to the facility at any time. If a member is found to have granted entry to a non-member whether intentionally or negligently their membership will/maybe be terminated immediately. The member will be required to pay all remaining membership fees in full, along with an additional £100 administrative charge.

Additional services
1. Personal Training Sessions and “additional services” do not form part of this Agreement and are not provided by us .
2. Any “additional services” (including, for example, Personal Training Sessions, Sports Therapy and Massage Therapy beauty treatments and blood analysis ) which you contract for or agree to pay for, do not form part of your Membership Agreement and the Terms & Conditions of this Agreement will not apply to them. You should be aware that if you enter into any agreement for “additional services”, you are entering into an agreement with those individuals and not with us.
3. We do not accept any liability for any losses, damage, personal injury or other loss caused by any negligent act or omission of those providing the “additional services” which are specifically excluded from the Membership Agreement and We do not accept any responsibility for the same save where precluded by law.
4. We may provide induction services or personal reviews of your training needs. Such services are provided without additional charge.
Supp shack Additional services include Ice bath/Sun beds.
Ice Bath Policy
Overview: The use of an ice bath is a recovery method that can aid in reducing inflammation, soreness, and fatigue. Members of our facility may use the ice bath for an additional fee on top of their existing membership. Non members must also be aware of the following policy.
The purpose of this policy is to establish guidelines for the safe and effective use of the ice bath.
Cost: The cost of using the ice bath is an additional fee of £4.99 per use or a bolt on can be added to your existing membership at a price of £13.99. This fee must be paid at the front desk prior to using the ice bath or as part of your monthly payments. Members will not be allowed to use the ice bath without paying the additional fee.
Usage: The ice bath will be available during regular business hours 6am-8pm. Members must sign up for a time slot to use the ice bath in advance to ensure availability. The maximum time allowed for use of the ice bath is 15 minutes. Members must be fully cleaned and have showered prior to using the ice bath.
Health Considerations: The use of an ice bath can be beneficial for recovery, but it may not be appropriate for everyone. Members with certain health conditions, such as cardiovascular disease or cold intolerance, should consult with their GP/Consultant prior to using the ice bath. Members who are pregnant or have open wounds should not use the ice bath.
Safety: Members must follow safety guidelines when using the ice bath. The ice bath should never be used alone. Members should always have a partner present to assist them in and out of the ice bath. Members should also monitor their time in the ice bath and exit immediately if they experience any discomfort or numbness. Members should never submerge their head under the water.
Cleaning: The ice bath will be cleaned and disinfected after each use. Members are responsible for drying themselves off and wiping down the ice bath after use. If any issues arise with the ice bath, please inform the front desk immediately.
Enforcement: Failure to follow this policy may result in suspension or termination of membership. Members must sign a waiver indicating that they have read and agree to follow this policy and usage rules prior to using the ice bath.
Sun beds
This policy outlines the guidelines for the safe and effective use of sun beds at our facility. As part of our commitment to ensuring the safety of our members, we have implemented an additional fee for sun bed use, and require all users to complete a usage card prior to use.
Cost : In order to use our sun bed, members will be required to pay an additional cost on top of their existing membership. This fee will be charged on a per-session/block basis.
Usage Card: Before using a sun bed, all users must complete a usage card. This card will require users to provide information about their skin type, any medical conditions or medications that could increase their risk of skin damage, and any previous experience with sunbed use. The usage card must be completed in full and signed by the user before they are allowed to use the sunbed.
Age Restrictions: No person under the age of 18 years will be permitted to use our sun bed.
Time Limits: The amount of time an individual spends on a sun bed should be limited based on their skin type and the intensity of the UV radiation emitted by the sun bed. The recommended time limit for sun bed use is typically 10-20 minutes.
Eye Protection: All users must wear appropriate eye protection while using a sun bed to reduce the risk of eye damage from UV radiation. Eye protection can be found at reception .
Hygiene: Sun bed users should be required to clean the sun bed before and after use, and to use a towel or other barrier between their skin and the sun bed surface to prevent the spread of bacteria and germs.
Prior use : Prior to using a sun bed, individuals should receive advice from a medical professional about the risks associated with sun bed use if they have any skin condition which may result in further complications.
Sauna Usage Policy:
Cost:
The sauna is an additional services which does not form part of your membership and this can be purchased as a pay a you go at £6.99 for a 35 minute use or as a block of 10 at £59.99. Both of these must only be used by the purchaser.
Age Restriction:
- Infrared sauna usage is restricted to individuals aged 18 and above. Persons under the age of 18 are not permitted to use the sauna for safety and health reasons.
Health Considerations:
- Prior to using the infrared sauna, individuals with pre-existing health conditions, pregnant women, or those taking medications should consult with a healthcare professional to ensure that sauna usage is safe for them.
Session Duration:
- Users are advised to limit each sauna session to a reasonable duration, typically not exceeding 30 minutes. Prolonged exposure may lead to dehydration or other adverse effects.
Hydration:
- It is crucial for users to stay adequately hydrated before, during, and after sauna use. Drinking water is encouraged to prevent dehydration.
Attire:
- Sauna users are required to wear appropriate and modest attire, such as towels or swimsuits, to maintain a comfortable and respectful environment for all users.
Cleanliness:
- Users must enter the sauna with clean, dry bodies. The sauna should be kept clean, and users are responsible for cleaning up after themselves.
Supervision:
- Users should not use the sauna without proper supervision. In case of any medical emergencies or discomfort, users are advised to exit the sauna immediately and seek assistance.
Maintenance:
- Sauna equipment and facilities must be used in accordance with provided instructions. Any malfunction or maintenance concerns should be reported promptly to the facility management.
Facility Rules:
- Users must adhere to all additional rules and regulations posted within the sauna facility.
Failure to comply with these guidelines may result in the denial of access to the infrared sauna. Facility management reserves the right to modify these rules as needed and enforce appropriate consequences for non-compliance.
Member satisfaction surveys
1. From time to time we may choose to invite some of our members to participate in a survey of satisfaction. This invitation will usually be by e-mail.
2. At our discretion member satisfaction survey participation may be associated with a prize draw offering prizes of varying amounts to participants. Members that respond to such an invitation by completing the satisfaction survey by the advertised closing date will be entered into the draw.
3. Eligible participants will only be entered once into a particular draw. A winner will be chosen at random from all entrants to that draw within 90 days of the closing date. Winners will be contacted after the prize is drawn to arrange receipt of the prize.
Other clauses
1. Only you, the person named in the online joining process, can benefit from this Agreement.
2. If any of the terms of this Agreement are invalid, unenforceable or illegal the remaining terms can still be enforced.
3. Strength Shack, its parent companies, its agents, employees and subcontractors are not liable for any loss, damage or theft of any of your property that you bring onto any of our premises. If such loss, damage or theft is caused by the negligent acts or omissions of Strength Shack or its agents, employees or subcontractors, our liability to you will be limited to £500.
4. We may make reasonable changes to the Gym Membership Rules and the Membership Agreement at any time. It is your responsibility to check online at regular intervals for changes to these documents.
5. This Agreement is governed by the law of England and Wales.
6. You should print a copy of this Agreement for future reference.
